In this 35 minute audio podcast, expert housing law trainer and solicitor Mark Robinson discusses in detail the changes to the case-law defining vulnerability for the purposes of homeless priority need in England.

This new February 2016 version of the podcast is fully updated to reflect the judgment of the Supreme Court in Hotak v Southwark LBC and other cases (2015) UKSC 30.

Establishing a priority need for housing is the key to obtaining accommodation from a local authority in cases of homelessness; for many homeless people the only priority need category which may apply is that of 'vulnerability' for one or more special reasons. The Supreme Court has revisited and reviewed the correct test to be applied by local authorities in cases of this kind; the test set out in R v Camden LBC ex p Pereira (1998) has been discarded.
